The Legislative decree nr.196 of June 30th 2003 (Code with subject protection or the personal data) provide for guardianship of the persons and other subjects concerning the treatment of personal data. The Legislative decree nr.196/2003, Article 7 – Right to access to the personal data and other rights.
The person concerned has the right to know if the personal information given concerning himself are existing or not, even not recorded yet.
The person concerned has the right to obtain:
a) the origin of personal data;
b) the matter and the way of the treatment;
c) the logic used for the electronic treatment of data;
d) the personal details of the holder and the nominated manager under art. 5, paragraph 2;
e) the subject or group of subjects to who the personal data can be shared.
The person concerned has the right to obtain:
a) the update, the modification or the integration of personal data;
b) the cancellation, transformation in nameless information or block of data in case of violation of law, included the ones for those storage is not necessary in connection with the purpose for which they were collected;
c) the confirmation that what on points a) & b) have been reported to the ones that data have been shared except the case on which the carrying out of the operation is impossible or it requires disproportionate efforts compared the protected right.
The person concerned has the right to oppose, completely or partially:
a) to the treatment of personal data for lawful matters;
b) to the treatment of personal data with the purpose of advertising dispatch, direct sale or for market research and commercial communication.
